Welcome to Thomas Rhett’s official website! We at Home Team Data Hub, LLC (“Home Team,” “we,” “us,” or “our”) take protecting your privacy seriously. In order for our websites, applications, and any corresponding service to function, we need to collect some of your information. This Privacy Policy (“Policy”) explains the information we collect about you, how we use it and share it, and your privacy rights. This Policy applies to the personal information collected from you when you visit our website located at https://www.thomasrhett.com, https://thomasrhettshop.com/, and  https://hometeam.thomasrhett.com or any other websites, pages, features, or content we own or operate (collectively, the “Site(s)”); install and use our mobile applications (“App(s)”); use or participate in our online or offline services; purchase albums, merch or other products from our shop; or interact with other products or services that direct you to this Policy (collectively, our “Service(s)”). 

Please read this entire Policy to make sure you fully understand it. You should also be sure to carefully review other Terms applicable to your use of our Services. By accessing and using our Services, you acknowledge this Privacy Policy, and you agree to our Terms of Use. If you do not agree with or you are not comfortable with any part of this Policy, please immediately discontinue access or use of our Services. 

We may change this Policy from time to time. If we make a change to this Policy that we believe materially affects how we process your personal information or reduce your rights, we will provide you with additional notice (such as adding a statement to our homepage or sending you a communication). We may also provide “just-in-time” disclosure or additional information about our data collection, use and sharing practices of specific Services. These notices may supplement or clarify Home Team’s privacy practices or may provide you with additional choices about how we process your personal information. 

1.     Who We Are 

Our website (located at https://www.thomasrhett.com) and our web store (located at https://thomasrhettshop.com/) are operated by Big Machine Label Group, LLC (“BMLG”) and Merch Traffic (“Merch Traffic”), respectively  on behalf of Home Team. BMLG, Merch Traffic and Home Team act as independent controllers with respect to the collection and processing of personal information from these websites. Please also refer to BMLG’s and Merch Traffic’s privacy policies on their information privacy practices. 

Our home team website (located at  https://hometeam.thomasrhett.com/) is operated by Home Team. 

2.     Personal Information We Collect 

We collect certain personal information about you and your use of our Services. Personal information is generally any information that identifies you or makes you identifiable. The personal information collected falls into three primary categories: (a) information you voluntarily provide us, (b) information we collect from you automatically, and (b) information we receive from third parties. 

Information You Voluntarily Provide. We, or our service providers that assist us in providing, maintaining, and operating our Services, may collect the following types of personal information from you: 

  • Account Registration: When registering a Home Team membership account with us, we may collect your name, mailing address, email address, phone number, age, gender, date of birth, country, and your account information. We also may collect your preference information such as music or artist preferences. 
  • Photos and Videos: We may collect photos and videos that you post to our Services or provide to us. 
  • Product Purchase: We may collect your personal information when you purchase album, merchandise, or other products from our online shop, including, for example, your first and last name, mailing address, postal code, email address, phone number, order confirmation, shipping tracking number and records of your purchases from us, any returns you make, or products you are considering purchasing from us (e.g., items in your cart). 
  • Payment Information: In order to facilitate any purchase, our service provider may collect your payment information, such as your billing address, credit or debit card information or other preferred payment means. , and 
  • Support. When you engage with our support team, we may collect records, copies of your correspondence (including email addresses and phone numbers), or additional information you choose to share with us. 
  • Email Updates. You may choose to provide us your email address if you wish to receive promotional emails from us with news & exclusive offers. 
  • Social Media: If you use a third-party service (e.g., Facebook, Google, or Twitter) to create an account, we may receive personal information that you allow such a third-party service to share with us such as your name, email address, profile picture, or other personal information. If you choose to interact with us through a third-party social network (e.g., Instagram), we may collect personal information from your profile on the social network, like your username and any other personal information you make publicly available. Please be aware that any information you submit or post to a social media site, such as Instagram, is done at your own risk and without any expectation of privacy. We cannot control the actions of social media site users and are not responsible for any content or submissions contained on such sites. 

Information We Automatically Collect. To the extent permitted under the applicable law, we may collect certain types of information automatically, such as whenever you interact with the Sites or use the Services. This information helps us address customer support issues, improve the performance of our Sites and Services, provide you with a streamlined and personalized experience, and protect your account from fraud by detecting unauthorized access. We may collect following types of information automatically from you: 

  • Technical Data and Log Information: Information about your device and your use of our Services, including the device hardware model, operating system and version, type of browser you use, times you access our Services, average time spent on one of our websites, pages viewed, your IP address, device information related to your choice of settings such as GPS and Bluetooth settings, location information if you enable this on your device operation system and you are using a location-based service (you may turn off location information at any time within the device settings), MAC address, transactions with APIs, website or application usage activity, and the referring link through which you accessed one of our websites. 

Information We Receive from Third Parties: From time to time, we may receive your personal information from our affiliates or subsidiaries, or from recording artists or their representatives that you have authorized to share your personal information with us. 

3.     How We Use Your Personal Information 

We may use your personal information for the following commercial purposes, unless restricted by applicable law: 

(a)   To Provide Our Services. 

We use personal information we gather through the Services to provide you with our Services that you request, such as creating and managing your membership accounts, providing exclusive content and access lottery, processing your album or merchandise orders and/or responding to your inquiries. 

(b)   To Provide You with Service-Related Communications.

We may use your personal information to communicate with you. We may send you administrative or account-related information to keep you updated about your account and the Services. Such communications may include information about privacy policy and terms updates, security updates, tips or other relevant membership-related information. Service-related communications are not promotional in nature, and thus you are not able to unsubscribe from them. 

(c)    To Provide Customer Support or Respond to You

We collect any information that you provide to us when you contact us. Without your personal information, we cannot respond to you or ensure your continued use and satisfaction of the Services. 

(d)   To Provide Marketing Communications. 

If you have voluntarily provided your email address, phone number or other electronic addresses to us when subscribing to our marketing communications, we may email you about Artist’s music, exclusive contents, materials, event, and/or promotions that we believe may be of interest to you. When you no longer wish to receive these marketing messages from us, you can opt out at any time by following the instructions contained in each email you receive from us or contacting us via the methods specified in the “Contact Us” section below. 

(e)   To Research and Develop of Our Services. 

We may process your personal information and derive analytical and statistical data to better understand the way you use and interact with our Services. For instance, analyzing where, on which types of devices and how our Site is used, how many visitors we receive, and where they click on the Site may help us improve our existing Services and to build new Services. Please see our Cookies and Other Similar Tracking Technologies section for more information. 

(f)    To Personalize Your Experience

We may process your information to personalize your experience. By personalization, we enable you to interact with our Services more easily across platforms and devices. 

(g)   To Facilitate Corporate Acquisitions, Mergers and Transactions

We may process any information regarding your account and your use of our Services as is necessary in the context of corporate acquisitions, mergers or other corporate transactions. 

(h)   To Enforce Compliance with Our Terms, Agreements and Policies. 

When you access or use our Services, you are bound to our Terms. We may process your personal information when actively monitoring, investigating, preventing and mitigating any alleged or actual prohibited, illicit or illegal activities on our Services. We may also process your personal information to investigate, prevent or mitigate violations of our internal terms, agreements or policies; and enforce our agreements with third parties. 

(i)     To Detect and Prevent Fraud and Security Risks. 

We may process your personal information to combat spam, malware, malicious activities or security risks; improve and enforce our security measures; and to monitor and verify your identity so that unauthorized users do not gain access to your information. 

(j)     To Maintain Legal and Regulatory Compliance. 

Our Services are subject to certain laws and regulations which may require us to process your personal information. For example, we process your personal information to fulfill our business obligations, or as necessary to manage risk as required under applicable law, or to respond to requests by judicial process or governmental agencies. 

(k)   With Your Consent.

 
For any other purpose disclosed to you prior to you providing us your personal information or which is reasonably necessary to provide the services or other related services requested, with your permission or upon your direction. 

 
4.     How We Share Your Personal Information 

We may share your personal data as needed to fulfill the purposes described in this Policy and as permitted by applicable law. Examples of how we may disclose your personal data include the ways below 

(a)   With Affiliates and Subsidiaries: We may disclose your personal information to subsidiaries and affiliates for one or more purposes described in the “How We Use Your Personal Information” section above. 
(b)   With Our Service Providers: Disclosures of your personal information to non-affiliated companies or individuals we hire or work with that perform services on our behalf, including customer support, web hosting, web development, data management, payment processing, product fulfillment, security, fraud control, marketing, events and promotional services, and analytics services. We only disclose the information required by the service provider or third party to perform the respective service for us. 
(c)    Corporate Transaction: Personal information may be disclosed or transferred as part of, or during negotiations for any purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal, securitization, or financing involving us. 
(d)   As Required by Law. We may disclose your information if we believe that the disclosure is required by law, if we believe that the disclosure is necessary to enforce our agreements or policies, in response to valid requests by public authorities (e.g., a court or a government agency), or if we believe that the disclosure will help us protect the rights, property, or safety of Home Team, other users, or public at large. 
(e)   With Our Business Partners. Subject to applicable law, we may share your personal information with our business partners, such as with data providers, promotional partners for permitted marketing purposes, or for co-sponsored events based on your voluntary participation. 

(f)    With Your Consent. We may disclose your personal information for any purpose with your consent. 

 
5.     Cookies and Similar Tracking Technologies 

We, and third parties on our behalf, use cookies and similar tracking technologies (collectively, “Tracking Technologies”) to collect personal information automatically as you interact with our Services, to help us customize your experience and better manage content on our Sites, including to: 

•               Analyze our web traffic and usage. 
•               Identify whether you already visited our Services. 
•               Store information about your preferences. 
•               Keep track of items stored in your part for purchase. 
•               To recognize when you sign in to use our Services. 
•               Prevent fraudulent activities and improve security. 

Cookies. When you visit our Sites, we (or third-party data or ad networks we work with) may send one or more “cookies” to your computer or other devices. Cookies are alphanumeric identifiers stored on your computer through your web browser and are used by most websites to help personalize your web experience. Some cookies may facilitate additional site features for enhanced performance and functionality such as remembering preferences, analyzing usage for site optimization, allowing third parties to provide social sharing tools, and serving images or videos from third-party websites. 6.     Third-Party Sites and Services 

Our Services may contain links to third-party websites. The third parties you interact with may have their own privacy policies, and Home Team is not responsible for their collection and use of data. We encourage you to check the applicable third-party privacy policy and terms of use when visiting or using any third-party services. 

7.     How We Protect Your Personal Information 

We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once it is received. However, since the internet is not a completely secure environment, we cannot ensure the security of information during its transmission between you and us. If you feel that the security of any account you might have with us has been compromised, you should contact us immediately as described in the “Contact Us” section. 

8.     How Long We Keep Your Personal Information 

We will retain your personal information as long as necessary to fulfill the purposes outlined in this Policy, unless applicable law prescribes a specific retention period. We will retain and use information as necessary to comply with our legal obligations, resolve disputes, and enforce our rights. We will cease to retain your personal information or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal information was collected, and is no longer necessary for legal or business purposes. To cancel your account or request that we no longer use your information to provide you services, please contact us via the method identified in the “Contact Us” section below. We may still retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. 

9.     Children Under 16 

We do not, in providing our Services, knowingly collect personal information from children under 16 years old. If you have reason to believe that a child has provided personal information to us via the Services, please contact us as described in the “Contact Us” section below, and we will take steps to remove the personal information from our storage systems and terminate the account if we determine that a child under 16 has used the Services. 

10.  For Non-U.S. Residents 

We operate our Services from the United States. If you are located outside the United States and choose to use our Services or provide information to us, you acknowledge and understand that your information will be transferred, processed, and stored in the United States. United States privacy laws may vary from those in your jurisdiction. We will protect your information in accordance with this Privacy Policy wherever it is processed. We will take appropriate contractual or other steps to protect the relevant personal information in accordance with applicable laws. 

11.  Your Choices and Privacy Rights

Your Choices 

We offer you certain choices about how we communicate with you and what information we collect from you. 

(a)   Correct or Update Your Information. If you have created a user account through the Services, you will have the ability to access, update and correct the personal information you have provided in connection with your account by logging into your account through the Services. 
(b)   Marketing Communication. You can opt-out of receiving certain promotional or marketing communications from us at any time by using the “unsubscribe” link in the emails communications we send. If you have any account for our Services, we will still send you non-promotional communications, like service-related emails. 

Your Privacy Rights 


Depending on applicable law where you reside or are located, you may be able to assert certain rights identified below with respect to your personal information. If any of the rights listed below are not provided to you under the law that governs the processing of your personal information, we have absolute discretion in providing you with those rights. Please refer to the “What Rights Apply” section to determine the rights you have in the jurisdiction you reside. 

Please note, your rights in relation to your personal information are not absolute. Depending upon the applicable law, access to your rights under the applicable law may be denied: (i) when denial of the request is required or authorized by law; (ii) when granting the request would have a negative impact on another's privacy; (iii) to protect our rights and properties; (iv) where the request is frivolous or vexatious, or for other reasons. 

  1. Right to Know/Access.
You may have the right to obtain a copy, or a list of categories of the personal information that we hold about you, as well as other supplementary information, such as the purposes of processing, and the entities to whom we disclose your personal information.
 
2. Right to Correct/Rectification.
You may have the right to correct any of your personal information in our records and systems. You may request us to rectify, correct or update any of your personal information held by us that is inaccurate.

3. Right to Delete/Erasure.
Under certain circumstances, you may have the right to request that we delete the personal information that we hold about you. This right is not absolute, and we may refuse your right to delete if it is reasonably necessary for us to provide a service requested by you; to perform a contract between us; to maintain functionality and ensure security of our systems; to enable solely expected internal uses of your personal information; to exercise a right provided by law; to comply with a legal obligation, or if there are compelling legitimate grounds for keeping your personal information.

4. Right to Portability.
Under certain circumstances, you may have the right to receive personal information we hold about you in a structured, commonly used, and machine-readable format so that you can provide that personal information to another entity.

5. Right Against Discrimination.
You have the right not to be discriminated against for exercising any of the rights described in this section. We will not discriminate against you for exercising your privacy rights.

6. Right to Object to Automated Decision-Making.
You may have the right not to be subject to a decision that is based solely on automated processing (where a decision is taken about you using an electronic system without human involvement) which significantly impacts your rights. No decision will be made by us about you solely on the basis of automated decision making which has a significant impact on you.

7. Right to Appeal.
You may have the right to appeal if we refuse to take action on your rights request. Instructions on how to appeal will be provided to you upon such a denial, but in any event, such instructions will be substantially similar to those provided below for submitting requests.

8. Right to restriction. 
You have the right to request that we restrict our processing of your personal information in certain circumstance. For instance, this right is available if you contest the accuracy of the personal information, or you objected to our processing.

9. Right to object to processing. 
You have the right to object to our processing of your personal information at any time and as permitted by applicable law if we process your personal information on the legal bases of consent, or legitimate interests. However, we may continue to process your personal information if it is necessary for the defense of legal claims, or for any other exceptions permitted by applicable law.

Submitting a Request to Exercise Your Privacy Rights

To assert your privacy rights noted above, please email hometeam@thomasrhett.com and indicate which rights you would like to exercise. Please note California and Colorado residents may do so up to twice per year per customer. We may charge a reasonable fee for multiple requests in the same 12-month period, as permitted by law.

To protect your privacy, we must be able to verify your identity to confirm that the request came from you before we can process your request to exercise any of the privacy rights that you may be entitled to under the applicable law. We may contact you by phone or e-mail to verify your request. Depending on your request, we will ask for information such as your name, an e-mail address that you have used with Home Team, or a phone number you have used with Home Team. For certain requests, we may also ask you to provide details about the most recent purchase you made online.

Residents of California, Colorado, and Connecticut may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.

Your Opt-Out Rights

If you reside in California, you may have the right to opt-out of certain types of processing for your personal information.

(a)   Right to Opt Out of Sale.  You may have the right to opt-out of the sale of your personal information. We generally do not sell your personal information for profit, but like many businesses, we use cookies, pixels, and similar technology on our Sites, and we share certain personal information, such as your IP address or device identifiers, to third-party advertisers in order to improve your user experience and to optimize our marketing activities. Under the broad definition of “sell” contained in some jurisdiction’s privacy laws, this could be considered a sale.

(b)   Right to Opt Out of Sharing for Targeted Advertising.  You may have the right to opt-out of the sharing of your personal information to third parties for behavioral or cross-contextual advertising purposes. Like many websites, we use cookies, pixels, and similar technology, and we share certain information, such as your IP address or device identifiers, to certain third-party advertisers in order to improve your user experience and to optimize our marketing activities. You have the right to direct us not to share or use your personal information for targeted advertising purposes.

To exercise your right to opt-out of sales and targeted advertising, please click the “Do Not Sell or Share My Personal Information” link in the website footer. Please note that you may still receive generalized ads after opting out of targeted advertising. 

You may also opt-out of sharing and sales by using an opt-out preference signal. The Global Privacy Control signal is currently the only opt-out preference signal we can recognize. You can visit the Global Privacy Control official site at https://globalprivacycontrol.org/#about to learn how to configure your device to send such signals. We will honor and process the opt-out preference signal in a frictionless manner. Please note that the opt-out choice will only apply to your use of our Sites through the current browser or device you are using and only so long as that browser’s cookies are not erased. You will need to submit a separate opt-out of sharing request on each device and browser you use to visit our Sites to completely opt-out using this method.

12.  Additional Notice to Individuals in European Economic Area, Switzerland, the United Kingdom

This section only applies to individuals using or accessing our Service while located in the European Economic Area, the United Kingdom, or Switzerland (collectively, the “European Countries”) at the time of data collection pursuant to the European Union’s General Data Protection Regulation, the UK General Data Protection Regulation or the Swiss Data Protection Act (collectively, the “GDPR”).

We may ask you to identify which country you are located in when you use or access some of the Services, or we may rely on your IP address to identify which country you are located in. When we rely on your IP address, we cannot apply the terms of this section to any individual that masks or otherwise hides their location information from us so as not to appear located in European Countries. If any terms in this section conflict with other terms contained in this Policy, the terms in this section shall apply to individuals in a European Country.

Right to Lodge a Complaint to Your Local Data Protection Authority

If you reside in the European Countries, you may have the right to lodge a complaint with a supervisory authority or equivalent regulatory body. You can find details of EEA Supervisory Authorities here: https://edpb.europa.eu/about-edpb/board/members_en. The Supervisory Authority in the UK is the Information Commissioner’s Office (ICO).

13.   California Consumer Privacy Notice

If you are a California resident, this section applies to you in addition to the rest of this Privacy Policy.  The California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”) requires us to disclose the following additional information related to our privacy practices.

  • Geolocation data, to the extent you have configured your device to permit us to collect such information;
  • Audio or Visual information, such as audio recordings of your voice to the extent you call us, as permitted under applicable law; and
  • Inferences drawn from any of the information listed above, such as your shopping preferences, characteristics, and behavior.

We generally do not collect protected classifications about our users, biometric information, professional or employment-related information, or education-related information. For more information about the personal information we collect and how we collect it, please refer to Section 2 above.

We collect and use your personal information for the following business purposes:

  • Performing services, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytics services, providing storage or similar services;
 
  • Providing advertising and marketing services;

  • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance;

  • Helping to ensure security and integrity;

  • Debugging to identify and repair errors that impair existing intended functionality;

  • Short-term, transient use, such as non-personalized advertising shown as part of your current interaction with us;

  • Undertaking internal research for technological development and demonstration; and 

  • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us.

    Sale or Share of Personal Information

    We may share or sell your identifiers, device information, demographic information and geolocation to advertising networks, and our business partners. To exercise your right to opt-out of sales and targeted advertising, please click the “Do Not Sell Or Share My Personal Information” link in the website footer. Please note that you may still receive generalized ads after opting out of targeted advertising. 

    You may also opt-out of sharing and sales by using an opt-out preference signal. The Global Privacy Control signal is currently the only opt-out preference signal we can recognize.
